1. Acceptance of Terms

By downloading, installing, or using the NutriVision application (the "App"), you accept these Terms and Conditions in their entirety. If you do not agree, do not use the App.

2. Service Description

NutriVision is a mobile nutritional assistance application that offers:

Meal, hydration, and weight tracking
Food image analysis via artificial intelligence
AI-based nutritional chat
Personalized reminders
Recommendations tailored to your profile

3. Important Medical Notice

⚠️ NutriVision is NOT a medical service. The information provided is of a general and informational nature, and does NOT replace diagnosis, treatment, or advice from a qualified healthcare professional.

Always consult your doctor, nutritionist, or healthcare provider before:

Starting any significant dietary change
Making decisions related to pre-existing medical conditions
Using the App if you are pregnant, breastfeeding, or have special health conditions

4. User Account

You must be at least 13 years old (16 in the European Union) to create an account
You are responsible for maintaining the confidentiality of your password
You must provide accurate and up-to-date information
You may not transfer your account to another person
We reserve the right to suspend or cancel accounts that violate these Terms

5. Acceptable Use

You agree NOT to:

Use the App for illegal or unauthorized purposes
Attempt to access data of other users
Reverse engineer or extract the source code
Use the App to harm our systems or those of third parties
Send offensive, discriminatory, or illegal content to the AI chat
Automate the use of the App via bots or scripts

6. Premium Subscription

NutriVision offers a free plan and a Premium plan with additional features:

6.1 Free Plan

Up to 5 daily messages in the nutritional chat
Up to 5 food photo analyses per day
Basic tracking access

6.2 Premium Plan

Up to 50 daily messages in the nutritional chat
Extended photo analysis
Full history and PDF export
Macro and weight evolution charts
Advanced personalization features

6.3 Payments and Renewals

Payments are processed via Google Play Billing
Subscriptions auto-renew unless cancelled
You can cancel anytime from your Google Play account
Refunds are governed by Google Play policies

7. Intellectual Property

All rights to the App, its design, code, trademarks, and content are the property of NutriVision Labs or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App according to these Terms.

8. User Content

You retain ownership of the data you upload (photos, messages, records). By using the App, you grant us a limited license to process that data exclusively for the purpose of providing you the service, in accordance with our Privacy Policy.

9. Artificial Intelligence

The nutritional chat responses and photo analysis are generated by AI models (Claude by Anthropic). These models may make errors or generate inaccurate information. You should not rely exclusively on their responses for critical health decisions.

10. Limitation of Liability

NutriVision is provided "as is" and "as available." To the maximum extent permitted by law:

We do not warrant that the App will be error-free or uninterrupted
We are not liable for damages arising from decisions based on App content
Our total liability is limited to the amount paid in the last 12 months for the Premium subscription (if applicable)
We are not liable for indirect, incidental, or consequential damages

11. Indemnification

You agree to defend, indemnify, and hold harmless NutriVision Labs from any claim arising from misuse of the App or violation of these Terms.

12. Modifications

We may modify these Terms occasionally. Material changes will be notified by email or in the App. Continued use after notification implies acceptance of the new Terms.

13. Termination

You may stop using the App at any time by deleting your account. We may suspend or terminate your access if you violate these Terms. Upon termination, clauses regarding intellectual property, limitation of liability, and applicable law survive.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute will be resolved in the competent courts of the State of California, unless the law requires a different jurisdiction based on your country of residence.

15. General Provisions

If any clause is invalid, the rest of the Terms remains in effect
Our inaction regarding a violation does not imply waiver of future actions
These Terms constitute the complete agreement between you and NutriVision Labs
